PREAMBLE
The present and general conditions of sale are concluded between:
- The moral or physical person who wants to make a purchase on www.gabrieleanton.com, hereafter referred to as the Purchaser
- The Gabriele Anton limited company, with a capital of 7500 Euros, based in Metz (57070) France, 7 rue Loredan Larchey, hereafter referred to as Gabriele Anton
ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF SALE
The present and general conditions of sale aim to define the procedures of sale between Gabriele Anton and the Purchaser. They apply to all sales of products done directly to Gabriele Anton by email or through www.gabrieleanton.com.
Each order put on www.gabrieleanton.com necessarily presupposes the knowledge of the present and general conditions of sale. The agreement to these conditions of sale, without reservations, comes into effect during the order validation. Gabriele Anton reserves the right to modify at any time and without prior notice the general conditions of sale. These new general conditions of sale apply to any order after this modification.
CONDITIONS OF ORDERING
The Purchaser must have the legal ability or be aged 18 or over to place an order on www.gabrieleanton.com.
ORDERING PROCESS
The Purchaser can place his order :

The informations communicated by the Purchaser and collected by Gabriele Anton during the ordering procedure are the proof of the deal between the Purchaser and Gabriele Anton. Before the Purchaser submits his order it will be given to him opportunity to review his selection, check the total price of his order and correct any input errors.
After filling out the order form, the Purchaser is invited to click on the « Pay » push button which will confirm his order. The validation establishes the confirmation of the Purchaser’s order and constitutes an electronic signature having the same legal force as a handwritten signature. It will be equivalent to an irrevocable consent to the general conditions of sale.
Gabriele Anton reserves the right to refuse a delivery or to honour an order in case the Purchaser would not have paid totally or partially a previous order, or in case of payment dispute processing.
CARACTERISTICS AND AVAILABILITY OF PRODUCTS
Products offered by Gabriele Anton are handmade in France by craftsmen and companies, holders of a particular know-how. Photos and descriptions of the products displayed on www.gabrieleanton.com are representative of the original products but variations may occur due to the fact that the products are handmade. For each product a summary presentation indicates the name, the description, the unit price and the selected quantity. According to the article L. 111.1 of the French consumer code, the Purchaser can, prior to his order, contact Gabriele Anton via e-mail in order to get more information about the characteristics of the product he wants to order. Products mentioned on www.gabrieleanton.com are in stock. If several Purchasers order the same product, the availability of this one can vary. Gabriele Anton cannot be held responsible for this modification. If a product is unavailable after ordering, fifteen (15) days will be needed for the manufacturing of this product.
PRICE, PAYMENT AND CUSTOMS FORMALITIES
Prices
The prices of our products are expressed in euro (€), all taxes inclusive, and they are firm and definitive. All our prices are EXW, according to ICC Incoterms 2010. Gabriele Anton reserves the right to modify the prices at any time without prior notice. Delivery costs are automatically calculated during the order process and appear on the complete order page, prior to final validation by the Purchaser.
Customs duties
For delivery outside the European Union, the Purchaser agrees to pay all taxes applied to the import of products and claimed for the delivery of the products (customs duties, value added tax - VAT, and/or any other tax owed in accordance with the laws of the country where the products are delivered). Gabriele Anton denies any legal liabilities for non payment of such taxes by the Purchaser.
Payment
The products are only delivered on receipt of the total order’s payment. During order process the Purchaser chooses to pay by Bank transfer, by Credit Card or by Paypal. Gabriele Anton accepts the following Credit Cards : Visa and Eurocard.
The Purchaser assures Gabriele Anton that he has all the necessary authorizations to use a Credit Card during the order process. If the Purchaser chooses to pay by Bank transfer he can ask Gabriele Anton’s IBAN and SWIFT codes via e-mail at contact@gabrieleanton.com. He will need to mention the order reference and his name on the documents supplied by his bank for easier procedures.
If the Purchaser chooses to pay by Credit Card, he will be redirected to the secure website of our banking partner CIC, which ensures data privacy of the cardholders through protection and encryption procedures.
Invoices
For each sale Gabriele Anton will deliver an electronic invoice with the names of the interested parties, their addresses, the sale date, the quantity of the sold items, their exact designation and their unit price - net of VAT.
NON-PAYMENT AND PROPERTY RESERVATION
The ordered products remain the property of Gabriele Anton until all payments, inclusive of shipping charges and taxes, have been received. In the event of a payment problem, the Purchaser is obliged to return the received products to Gabriele Anton upon his request at the risk of legal proceedings. Any attempt of fraudulent use of means of payment will also liable to legal proceedings.
DELIVERY
Products purchased on www.gabrieleanton.com are only delivered in the countries listed hereunder. In addition, purchases may not be shipped to P.O. boxes or APO/FPO addresses.

- International : South Africa, Saudi Arabia, Argentina, Australia, Bahrain, Brazil, Canada, China, South Korea, the United Arab Emirates, The United States, Hong Kong, Israel, Japan, Kuwait, Lebanon, Mexico, New Zealand, Oman, Panama, Qatar, Seychelles, Singapore, Taiwan, Venezuela.
Any delivery address located outside this zone will be refused during the ordering procedure.
Gabriele Anton delivers ordered products by means of transport of his choice. Goods will be shipped to the delivery address specified by the Purchaser during the ordering procedure. If the delivery address is incorrect Gabriele Anton should not be held responsible for the impossibility of delivery. In such a case the costs for a new delivery will be chargeable to the Purchaser.
Gabriele Anton commits himself to deliver the ordered items as soon as possible according to the chosen mode of delivery. The delay in the execution of the shipment does not entitle the Purchaser to cancel the sale or claim any compensation. If several products are ordered at the same time and the delivery times are different, Gabriele Anton reserves the right to divide your order into partial shipments but you will be charged for a single shipment only.
Once the product is entrusted to the carrier the delivery is deemed to have taken place. The delivery note dated and signed by the Purchaser is the proof of the successful delivery.
Delivery problems
The Purchaser should check that his shipment is correct on delivery and in presence of the carrier. If there are any discrepancies or problems with his order when the products are delivered to him, he should note the nature of the discrepancy or problem (open package, damaged or missing item, error in delivered product) on the delivery note and sign. Then he should contact Gabriele Anton via e-mail at contact@gabrieleanton.com
Gabriele Anton is not held liable in the event that there is nobody who is competent to accept delivery of the products at the given address.
Delay in delivery
A failure to deliver or late delivery exceeding ten (10) days from the date of the order confirmation should be reported via email to contact@gabrieleanton.com as soon as possible. In order for the Purchaser’s claim to be accepted, he must notify Gabriele Anton of the delay within a maximum of fifteen (15) calendar days from the date of the order confirmation.
RETURNS-EXCHANGE-REFUNDS
The Purchaser benefits from the legal guarantee (article L 121-16 of the French consumer code). The Purchaser has a seven (7) days period for reflection after receipt of the ordered items. The Purchaser is entitled to return any ordered product according to the following conditions :
- Items must be sent unused in their original condition and packaging complete with their accessories to the following address : Gabriele Anton sarl, 7 rue Loredan Larchey 57070 Metz FRANCE. The Purchaser must inform Gabriele Anton via email at contact@gabrieleanton.com about this return and enclose the original receipt with his return or a copy if he is returning part of his order.
- It is his responsibility to give the proof that the goods have been returned and to return the goods by registered post or by any other means or carrier of his choice, which gives proof of posting and delivery. The return of the goods will be at his costs. Gabriele Anton has sole discretion in determining whether the products are in original condition when returned to gabrieleanton.com website.
- If all the return requirements are respected, Gabriele Anton will refund the amount paid for the goods in question, except for return costs, within thirty (30) days of receipt of goods, by bank transfer. No refund will be offered for goods that are returned incomplete, damaged or soiled.
- However, a product ordered on www.gabrieleanton.com, which has been subject of a personalized marking at the Purchaser’s request or designed according to the Purchaser’s specifications cannot be returned for exchange or refund.
Gabriele Anton will not be responsible or liable if any item the Purchaser wishes to return to the gabrieleanton.com is lost, misdirected or delivered late.
GOOD COMPLIANCE GUARANTEE
The Purchaser will benefit from the legal guarantees for latent defects of the sold products. Provided that the Purchaser proves the existence of latent defects, Gabriele Anton is legally obliged to repair all the consequences of such defects. The Purchaser must lodge a claim within the fifteen (15) days after the delivery of the products. In that case the product will be exchanged or refunded.
The guarantees do not apply to :
- Damages caused by the Purchaser because of an intentional bad use of the products.
- Damages caused by the Purchaser because of a bad maintenance of the products.
- The normal changes and fading of the colors of the item appearance and of the materials of which the products are made up by action of light, heat, liquid or solid.
- Damages caused by the use of unsuited cleaning products.
PROPERTY TRANSFER
Whatever means of payment is chosen by the Purchaser, the transfer of property to the Purchaser takes effect only after total payment of the ordered products. The transfer of liability to the Purchaser takes effect as soon as Gabriele Anton entrusts the product to the carrier.
INTELLECTUAL PROPERTY
All material on www.gabrieleanton.com (written texts, photographs, drawings, designs, illustrations, logos, trademarks...) are the exclusive property of Gabriele Anton. It is strictly forbidden to reproduce by any means or process, totally or in part, download or make use of any such material contained on www.gabrieleanton.com.
LIABILITY
The products offered by Gabriele Anton meet the french current legislation and standards. Gabriele Anton should not be liable to the Purchaser if he is prevented or delayed in the performance of any his obligations to him because of any cause beyond its reasonable control including (without limitation): explosion, fire, flood, accident, civil disturbance, postal or carrier strike, computer crash, problems with telecommunications or internet.
www.gabrieleanton.com is hosted by an outside provider and it cannot held liable for interruptions, inaccuracies, defects of the website or for all damages caused by fraudulent intrusion from a third party.
Gabriele Anton website contains links to other web sites operated by third parties. Such links are provided for your reference and convenience only. Gabriele Anton is not liable for the content, products, services, statements or privacy policies, offered, made or asserted in such sites. Gabriele Anton cannot be held liable for any indirect damage due to a bad use of the products.
PERSONAL INFORMATION
Upon ordering on www.gabrieleanton.com, the purchaser agrees to the use of the personal data provided by them or collected through the website. This information is essential for processing the orders.
In accordance with the provisions of the French “Computing and Liberties law” (nb 78-17 of January 6 1978), Gabriele Anton has notified the processing of personal information relating to customers to the French Data Protection Authority (CNIL). The customer has the right to access, correct or remove their personal data.
LAW AND DISPUTES
These general terms and conditions of sale and all operations mentionned in these are subject to the french law. All parties agree to accept electronic evidence (e.g. click order, email, backup...) as binding evidence in case of disputes.
In the case of a dispute the Purchaser will first contact Gabriele Anton (contact@gabrieleanton.com) to seek an amicable solution. Failing such amicable solution, the parties expressly agree that the Commercial Court in the jurisdiction of the registered office address of the seller (Metz in France) shall have sole competence to settle the dispute.
